Please read the following Terms and Conditions carefully as they cover all of our policies and govern Your use of Our website including the purchase of any products or services. Your use of Our website constitutes Your agreement to follow and be bound by these Terms and Conditions (the Agreement). If You are using the products and services on behalf of an organisation or entity (“Organisation”), then You are agreeing to these Terms and Conditions on behalf of that Organisation and You represent and warrant that You have the authority to bind the Organisation to these Terms and Conditions. Agreement: These ‘Terms and Conditions’ are a legally binding Agreement between You and Us.
Applicable: Any and all clauses or statutes, regulations, by-laws, ordinances or subordinate legislation in force from time to time, which is relevant to Your use of and access to Our website.
Business assets: Any of the following: goodwill; a statutory business licence; a right to use a statutory business licence; a business name; a right under a franchise arrangement; a debt of a business; a supply right of a business; intellectual property; personal property (e.g. trading stock or plant and equipment).
Reasonable time frame: According to the Australian Competition and Consumer Commission, “what is ‘reasonable’ will depend on the nature of the service and other relevant factors…”
References: Any reference to “Us”, “We”, “Our” or “Ourselves”, refers to Perfume Profiling © the business and any personnel, Mia Morrison, and perfumeprofiling.com the website. “You”, “Yourself”, “Your”, “Client”, “Consumer” and “Perfume Addict” refers to any visitor to the website, and anyone making a purchase from the website. “The website” refers to www.perfumeprofiling.com.

Accessibility for everyone on Our website is important to Us. We aim for Our Visitors to have an enjoyable shopping and learning experience. Perfume Profiling © is designed to allow all Visitors, including Visitors with disabilities, on most technological devices and web browsers, to have the best accessibility and a trouble free shopping experience. We also allow Visitors to manage their personal information when they register.
The Australian Government has advised that any publicly viewable website should comply with Level A of the Web Content Accessibility Guidelines 2.0 from the World Wide Web Consortium (W3C) to provide a minimum level of accessibility.

All Our products and services are subject to availability. If You have ordered a product or service which is no longer available, we will make every possible arrangement to get in touch with You, with the details You have provided. If no response within seven (7) working days (excluding weekends, Australian national and Queensland public holidays) of Our contact with You, We will either 1) refund the cost of the unavailable product or service paid by You, or 2) replace the product or service with a product or service suitable as a replacement. Our decision will be discussed with between Us as to the appropriateness and reasonability of our replacement and Our decision is final.
If You are not completely satisfied with Our email correspondence, You are more than welcome to unsubscribe via selecting ‘unsubscribe’ in an email received from Us. This should be immediate.
If You wish to terminate this Agreement or Your account with Us (if You have one), You may do so simply by discontinuing to use Our website.
You may cancel Your order at any time, provided it hasn’t left any of Our warehouses to be delivered to you. Once it arrives, you will need to follow the Returns, Refunds, and Exchanges procedures below.

Your cancellation will be validated within two (2) working days (excluding weekends, Australian national and Queensland public holidays) via reply email. Our email will confirm when your cancellation will be effective and the products due to be delivered, if any.
One-On-One Perfume Profiling Consultation Cancellations and Reschedules
Your one-on-one Perfume Profiling Consultation is an allocated time especially set for You. However, We understand that life happens, things may change and You may need to change Your consultation booking.
If You would like to cancel or reschedule Your one-on-one Perfume Profiling Consultation, please give Us at least 24 hours notice. If We do not receive the request to cancel or reschedule out of this 24 hours notice, then unfortunately, We are unable to refund or exchange the deposit paid for the consultation.
If You would like a refund and You have provided enough notice, the deposit paid, and any money paid for the one-on-one Perfume Profiling Consultation will be refunded back to the account which was charged at the time of purchase.
No shows and incidents beyond Our control are unfortunately treated the same, and will not be refunded or rescheduled. We will still invoice you for the full amount for the consultation if you do not show up. Cancellation by Us
We may terminate Your access to all or any part of Perfume Profiling at any time, with or without cause, with or without notice, effective immediately. We may terminate this Agreement and Your access to Our website (plus any orders for goods and/or services placed by You with Us by virtue of Your use of Our website) for any reason if we reasonably consider that You are in breach of any clause of these Terms and Conditions. This may occur without the need to provide reasons. All clauses of this Agreement which by their nature should survive termination, including, without limitation, content ownership and modification of such content, accuracy of information on Our website, disclaimers, implied terms, indemnity, copyright, trademark, linking to Our website, cancellations, limitations of liability and general provisions.
We may cancel Your Perfume Profiling Session or Your one-on-one Perfume Profiling Consultation, if We do not hear from You at all leading up to your booking. This is because the allocated time is especially set for You and Your Guests. We would hate to cancel Your booking, and We will try everything We can to confirm Your booking within 48 hours of the set time. If We do not hear back, then We will assume it is not going ahead and make a judgement as to whether it is reasonable to cancel Your booking.
Changes in these Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace any part of this Agreement at any time. It is Your responsibility to check this Agreement periodically for changes. Your continued use of or access to the website following the posting of any changes to this Agreement constitutes acceptance of those changes. We may also, in the future, offer new services and/or features through the website or one-on-one. Such new features and/or services shall be subject to the Terms and Conditions of this Agreement.
Anything posted to Our website or Our social media channels, belong to Us, including Intellectual Property which You own, as You:
- ascribe all your Intellectual Property to Us through such content posted;
- have granted permission for Us to communicate to the public in any way, in any form, on any appropriate platform, for any fitting purpose, to promote Our business and share Your happiness, without remuneration to You;
- consent Us to use the posted content in any manner we consider acceptable (in accordance with appropriate laws), royalty-free and without remuneration to You;
- are solely responsible for any content you post; and
- understand that any content You share which is personal, will be bound by Our Privacy and Security policy.

The Australian Competition & Consumer Commission: Advertising and Selling Guide, requires Us to ensure the content on the pages We manage are accurate, irrespective of who put it there. If someone posts something for the public to see which is misleading, offensive, unlawful, untrue or deceiving, We have a responsibility to moderate all comments regularly and if necessary delete the post. However, social media is used as an open, two-way forum and We encourage all comments on Our social media channels to improve the discussions on perfume and Our products and services.
All copyright items, including, without limitation to text, graphics, logos and icons, is owned by Us or third party licensors. Items obtained from a third party licensor may be the subject of copyright owned by that third party. According to the applicable sections under the Australian Copyright Act 1968 (Commonwealth), or excluding as expressly permitted by these Terms and Conditions, You must not:
a) copy, adapt, reproduce, store, distribute, print, display, perform, broadcast, publish, communicate to the public, make available to the public, nor create derivative works of the whole or any part of the material; or
b) commercialise the whole or any part of the materials without Our express written permission or, in the case of third party material, from the owner of the copyright in that material.
We deliver through the Officeworks ‘Mailman‘ service and because of this, We only deliver within Australia. Mailman offers a track and trace service, quick, simple and reliable. Every single parcel We send out will be insured and contents will be protected. This service only delivers to commercial and residential street addresses within Australia between 9am and 5pm Monday to Friday. We deliver to most of Australia but do not deliver to any PO boxes, some remote islands nor internationally.
Please supply a delivery address, either home or work, where the receiver will be when the parcel arrives. Signature on delivery is not required. This is because if the receiver lives far away from an Officeworks store (which in minimal cases you may need to collect from) we would hate to put the receiver out of their way.
If You require a signature on arrival, please notify Us immediately at Mia@PerfumeProfiling.com. If you request a signature on delivery and there is no one home to sign, the parcel will be redirected to the closest Officeworks store or the courier depot for collection. In that case, a delivery card will be left at the receiver’s address notifying them of the parcel location for collection. It is then up to You or the receiver to collect it from that specific location.
Please provide Us with the correct mailing address as We accept no responsibility for deliveries to the wrong address. If You provide Us with an incorrect address and Your order is returned to Us, We can redeliver, but at a charge of $12.50. This is the usual cost for Mailman to send parcels throughout Australia.
To ensure efficient delivery, please specify a daytime delivery address during Your checkout process, and highlight any other details which will help the delivery driver find the correct address.
We will use every endeavour to deliver Your parcel efficiently by the estimated date. However, We will not be held responsible, accountable or liable for any delays in delivery. We will make every effort to ensure Your parcel arrives within the estimated time frame. Time is not of the essence.
You can track Your order once You receive confirmation from Us that Your parcel has left Our warehouse, with the tracking number We include in Your confirmation email. Your parcel can be tracked through Officeworks Mailman website.
If You have not received the parcel within the time frame as shown below for the specific order, please look up Your parcel’s tracking number on Officeworks Mailman website. It is Your sole responsibility to notify Us at Mia@PerfumeProfiling.com, if there is a problem with Your parcel delivery.
We will not accept any responsibility for any delay or lost shipments as a result of Officeworks Mailman service and any of their affiliate courier services.
Delivery of Full Sized Fragrance Bottles
We will endeavour to deliver Your full sized fragrance product as soon as possible. Once it leaves Our warehouse, please allow up to ten (10) working days (excluding weekends, Australian national and Queensland public holidays) to reach Your delivery address. Once it leaves Our Warehouse, You will be sent a confirmation email with a tracking number for You to track Your parcel. If You haven’t received the parcel by the end of the ten (10) working days, We encourage You to look up Your parcel’s tracking number on Officeworks Mailman website. We only deliver to street addresses within Australia.
Orders under $50 will incur a flat delivery charge of $5.
The cost of delivery of Our full sized fragrance bottles is absolutely FREE!
We do not try or claim to exclude Ourselves from liability under any law with this disclaimer. If and to the extent, that such liability cannot be lawfully excluded (including, without limitation, any guarantee under the Australian Consumer Law).
Our suppliers, licensors, associated businesses and Us, hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Us nor Our suppliers, licensors, and associated businesses make any warranty that Perfume Profiling will be error free or that access thereto will be continuous or uninterrupted. You understand that unfavourable action will be taken, if You dare to download from, or obtain content through Perfume Profiling for the gain of Your, or a potential business and doing so will be at Your own risk. So please do not mis-appropriately copy.
To the extent permitted by applicable law, Australian legislation and Australian Consumer Law, We disclaim all warranties, either express or implied, as to the accuracy of the information We provide on Our website or information received with Our products and services. We take every endeavour to ensure Our website and promotional materials display the correct prices, descriptions and details.

We accept no liability for any delay or failure to perform Our obligations under these Terms and Conditions if such a delay or failure is due to circumstances beyond Our reasonable control.
Any waiver in whole or part, of any rights available to Us under these Terms and Conditions, is only valid if it is in writing and is limited to the case referred to in the writing or past breaches only if no case was referred.
If any clauses of these Terms and Conditions are found to be invalid, unenforceable or illegal for any reason, it is to be read down (applying the presumption of valid meaning), to give it as much effect as possible, or if it is not capable of having any effect at all, it is to be suspended from these Terms and Conditions. In which case, the remainder of these Terms and Conditions shall continue in full force.
This Agreement constitutes the entire agreement between You and Us concerning the subject matter hereof, and may only be modified by a written amendment signed by an authorised executive of Ours, or by the posting by Us of a revised version. Nothing in this Agreement shall be deemed to give rise to a relationship of agency or partnership or otherwise impose a duty of care upon Us in respect of Your use of Our website. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of Our website will be governed by the laws of the state of Queensland, Australia, excluding its conflict of law clauses, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts. You may assign Your rights under this Agreement to any party that consents to, and agrees to be bound by, its Terms and Conditions; We may assign Our rights under this Agreement without condition. General Representation and Warranty
You represent and warrant that (i) Your use of the website will be in strict accordance with Our Privacy and Security, Terms and Conditions, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in Australia, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from Australia or the country in which You reside) and (ii) Your use of the website will not infringe or misappropriate the intellectual property rights of any third party.

What would otherwise be implied, is excluded from these Terms and Conditions. This is subject to the non-excludable clauses of any applicable Australian legislation and Australian Consumer Law, and to the entire extent sanctioned by law, any guarantee, condition or warranty (including without limitation, any implied guarantee, condition or warranty of merchantability, satisfactory quality or fitness for a particular purpose).
Where any other legislation or Australian Consumer Law implies in these Terms and Conditions any guarantee, condition or warranty, and that legislation avoids or prohibits clauses in a contract excluding or modifying the application, exercise, or liability of, under such guarantee, condition or warranty, to the maximum extent permitted by law, Our liability for any breach of such shall be limited, at Our option, to one or more of the following:
a) if the breach relates to products: the replacement of the product or the supply of the equivalent product; the repair of such a product; the cost or replacing the product or of acquiring equivalent products; or the cost of having the product repaired; and
b) if the breach relates to services: the supplying of the services again or the cost of having the services supplied again.
You understand, acknowledge and agree that reliance by Us on this limitation of liability is fair and reasonable in all the circumstances.
You agree to indemnify and hold Us, Our contractors, and Our licensors, and their respective directors, officers, staff and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of Your use of Perfume Profiling, including but not limited to Your violation of this Agreement.
This Agreement does not transfer from Us to You any of Our or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with Us. Your use of the website grants You no right or license to reproduce or otherwise use any of Our or third-party’s Intellectual Property.
We are happy to introduce an interest-FREE (yippee!) payment plan for You. We follow the LAY-BY guidelines from The Australian Competition and Consumer Commission.
LAY-BY is only available to full-priced goods.
Our LAY-BY period is a maximum of four months and four easy payments. You are more than welcome to pay it off sooner. Goods will not be received until the full price has been paid.
We do not charge a LAY-BY fee (yippee!), provided the LAY-BY is paid in full and You have received the product. However, if the LAY-BY is canceled, We will then charge an administration fee of $10, which will be debited from the total amount of monies owed to You.
LAY-BY Minimum Purchase
Our LAY-BY Agreement is only for purchases above $100 at the full price.
Please complete the form on Our LAY-BY page. In the body of the email, please state what You would like to place on LAY-BY and how long You would like the payments to be over. The payments must not exceed four months and must be between two or four payments.
We will then reply to Your email with an invoice, which will include the LAY-BY AGREEMENT Terms and Conditions. The invoice will show the full price of the products and allow you to pay an installment.
For example, you might like to put a bottle of perfume ($250) on LAY-BY over four months with four payments. In this case, We would send You an invoice for $250, with a minimum payment (25% deposit) of $62.50 due immediately. Then You will receive reminders for the next payments due.
The LAY-BY deposit is the first payment which is due immediately. Depending on your requirements, the next payments will be due on an agreed date.
Fragrance samples, sales items, and one-on-one Perfume Profiling Consultations.
You can cancel Your LAY-BY agreement with us anytime before delivery of the goods to you. If you cancel, We must refund all amounts paid by You, less Our LAY-BY fee stated above. This fee will only be refunded to You, if the LAY-BY cancellation is canceled by Us.
We will only cancel the LAY-BY Agreement if: 1) You have breached a term of the agreement, for example, You fail to make scheduled payments on time, or 2) We are no longer engaged in trade or commerce or with that particular supplier, or 3) The goods are no longer available due to circumstances outside the supplier’s or Our control.
Limitation of Liability
In no event will We, or Our suppliers, licensors, or associated businesses be liable with respect to any subject matter of this Agreement under any contract, whether expressed or implied, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; or (iii) for interruption of use or loss or corruption of data; iv) any damages arising from death or personal injury caused by the negligence of Us or any of Our employees, agents or fraud. We shall have no liability for any failure or delay due to matters beyond Our reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
Linking to Our Website
You must receive written consent from Us if You would like to link Our website from another website or application. This will be at Our sole discretion and may be subject to any conditions We necessitate.
Thank You for choosing to purchase with Us. You must be 18 years or older to purchase Our products and services via Our website.
When You place an order with Us through Our website, We are notified of Your offer, which We will then advise You that it has been conditionally accepted or rejected. Our acceptance of Your order will take place upon dispatching Your order from Our warehouse. For any reason We deem appropriate, We reserve the right to reject Your offer to purchase Our products or services and will refund any monies owed to You in whole or part for any reason, including without limitation, the unavailability of products or services and any product or pricing errors.
You are able to correct anything on Your order up to the point at which You confirm and complete Your order on the final stage of Our order process.
After Your initial payment has been made and We have accepted Your offer of purchase, You are unable to cancel Your order, including as a result of any delay in delivery, apart from what is provided in this Agreement of Terms and Conditions.
With any products or services You purchase from Us, either via Our website or in person, You agree that you do not intend to resell what You ordered from Us. If this is Your intention, You are not permitted to purchase with Us. If we reasonably believe that You are purchasing from Us to resell, we may reject any orders You have offered, or if We have accepted any of Your orders, at any time.
Our packaging may vary from time to time and from that shown on Our website, Our social media channels and any advertising. The dimensions and weights described are approximates. However, We endeavour to make the descriptions of Our products and services as accurate as possible. We are also unable to control the colours of Our website You see on Your computer or device, as screen settings may differ from person to person.
When making Your payment online, You will be paying through PayPal Australia Pty Limited. These payment facilities accept payments from credit and debit cards. You do not need to have a PayPal account to purchase with Us.
Payments Made in Person
When purchasing products and services with Us face to face, You can pay with cash, or through Our Commonwealth Bank payment facility.
We are happy to introduce a payment plan for You, if you wish to pay off Your purchase in installments. Please see Our policy on LAY-BY Agreement above.
Payments will always be through these payment systems. You will be required to provide Your valid and correct credit or debit card details and You represent, confirm and warrant that You are the owner of such payment details. You may be required to validate Your details during the payment process. This activity is to ensure no fraudulent activity occurs. Perfume Profiling is available only to individuals who are at least 18 years old.
If We are unable to receive payment from You for Your order, We will contact You and may have to cancel Your order with Us.
We may retain legal possession of all products and services until full payment is made by You and received by Us. If we refund or exchange any payment for a product or service to immediately transfer back to Us the legal possession of that product or service which was refunded or exchanged.
Perfume Profiling Consultations
Perfume Profiling Consultations are a great way to meet with Mia, one-on-one, to discuss fragrances over a cup of tea or coffee, and to find You the perfect perfume based on Your personality, interests, and lifestyle.
When booking a Perfume Profiling Consultation, We require a 50% deposit to secure Your one hour booking. The remaining 50% is paid on the day of the consultation. Mia will send you an invoice for 50% payment which needs to be paid immediately via Paypal. Mia’s hourly rate will be discussed with you when arranging the booking day, time and location.
All one-on-one Perfume Profiling Consultations will receive a $30 credit towards the purchase of a large bottle.
The remaining cost and any purchases of Our products and services at the consultation, can be made with cash or through our Commonwealth Bank of Australia Emmy Facility which accepts all bank debit and credit cards.
All purchases made at Your Perfume Profiling Consultation, must be paid for within a week of the consultation, unless other methods such as Lay-by is agreed to by both parties.
For the moment, Perfume Profiling Consultations (in person) are only held in Brisbane and surrounding suburbs. If the location is to be held outside of Brisbane and longer than an hour to get to the location, then there will be a charge to cover Mia’s transportation costs. This charge will be redeemable on a certain amount of sales made, which is at the discretion of Mia and will be agreed on before the Perfume Profiling Consultation.

Perfume Profiling Sessions are a wonderful way to get Your family and friends together in the comfort of Your own home or workplace to enjoy a personalised Perfume Profiling Consultation. How does it work?
Contact us via Our Perfume Profiling Sessions page, or Our ‘Contact Us‘ page to see if We are available on the date and time You would like to make a booking for a Perfume Profiling Session.
Once confirmed, We will send You information, hints and tips on a successful session, and communicate with You leading up to the Perfume Profiling Session. We want Our Clients’ sessions to be lots of fun! In the time leading up to the session, We will send You a Perfume Profiling Session information pack. On the day, We will arrive with a bottle of bubbly, fragrances, booklets, other information and help You prepare the venue to ensure a successful event.
Your Guests will be warmly welcomed and will receive a glass of bubbly on arrival. Our consultant will introduce themselves, talk about the agenda for the day, then commence with guessing games to warm up the olfactory senses. You will learn interesting facts about Our sense of smell and why it’s so important, plus facts on application, storage, Fragrances of the World © and perfume notes.
The group Perfume Profiling Session will then start where We conduct it with Guests at the same time to encourage discussion.
Each Guest will receive five recommendations which they can then smell with Our specially made fragrance tubs, which contain specially made flowers which hold that particular smell. The Consultant will talk about the perfume brand, the fragrance itself and the journey it will take the wearer on.

Our fragrances are all European and are of the highest quality. Most of our brands we hold exclusivity for. You will never find them in any chemist, they will never be discounted and you will never find high street fragrance consultants as passionate about finding you the perfect perfume as us we promise, plus we come to you!
It is FREE to hold and attend a Perfume Profiling Session! Our sessions are fun, friendly, fragrant, fascinating but most importantly, they are FREE!
Any purchases of Our products and services at the session can be made with cash or through our Commonwealth Bank of Australia Emmy Facility which accepts all bank debit and credit cards.
In order to receive the bonuses, all purchases made at the Perfume Profiling Session must be paid for within a week of the session.

Perfume Profiling Session Terms
A minimum of four (4) Guests please.
For the moment, Perfume Profiling Sessions are only held in Brisbane and surrounding suburbs. If the location is to be held outside of Brisbane and longer than an hour to get to the location, then there will be a charge to cover Mia’s transportation costs. This charge will be redeemable on a certain amount of sales made, which is at the discretion of Mia and will be agreed on before the Perfume Profiling Session.
Each Guest should bring their own fully-charged device if they would like to perform their Perfume Profiling Consultation.
If more Guests turn up, this is great, the more the merrier!

Changes of Control and Business Ownership

You will be given the option in this notification of change to transfer Your personal information to the new controller or owner or request to have it withheld.

Returns, Refunds, and Exchanges
We hope You love Your products. We do everything in Our power to ensure Your product reaches You faultless and perfect, yet We understand that sometimes a product may arrive to You faulty or broken.
Where applicable, We follow the regulations of the Australian Competition and Consumer Commission of Repair, Replace, and Refund policy. If You are not happy with the working order of a product or products You have received, or if You have been sent an incorrect order, please email Us immediately at:

We will be happy to offer You a replacement, refund or exchange on all products returned to Us within fourteen (14) working days (excluding weekends, Australian national and Queensland public holidays) of your receipt of Our products to Your delivery address, provided they are in their original, unopened and unused condition. It is important that the products are returned in the same condition as sold and with Your receipt. Due to hygiene reasons, We cannot accept any fragrance returns that have been opened or used. They must be returned in a saleable condition.

Once We receive Your returned products, We will decide whether to accept Your request and if so, will exchange Your product for one of the same or greater value, or refund the cost.
Refunds will be credited to the debit or credit card that originally made the payment of those returned products within five (5) working days. If paid by cash, the refund will be transferred to an Australian bank account of your choice.
The cost of postage back to Us is paid by You, unless the return is Our fault, then we need a copy of the postage receipt in order to refund the cost of postage. We do not refund postage charges if it is not Our fault.
